Experience

Dick Ward has more than 30 years' international consulting experience covering the design and management of industrial construction projects, which is the foundation of his work in dispute resolution. He also advises on plant operations & maintenance.

He has worked as a forensic expert since 1978, gaining courtroom and international arbitration experience, including service as the tribunal’s independent expert in ICC arbitration proceedings, and single joint expert in UK court proceedings.

His clients include leading British and international firms pursuing or defending multi-million dollar claims under a variety of jurisdictions (British, Australian, South African, Saudi Arabian, and Turkish).

He has carried out numerous investigations, prepared engineer's reports, presented evidence in court, and has contributed to the out-of-court settlement of many actions. He also provides expert determination services. The following examples are representative of the range of his work in dispute resolution:

Construction dispute: Independent Expert appointed by the Tribunal

Construction dispute: Expert advisor in the preparation of case for arbitration

5MW Emergency Diesel Generation plant, UK

Expert witness, engine performance – gave testimony in the London TCC

4MW Offshore power generation facility

Construction dispute: Technical advisor to Queen’s Counsel acting as expert determinator

Pulp Mill Expansion, South Africa

Construction dispute: Lead expert in a team addressing issues of design, delay and disruption (settled)

Pulp and Paper Mill, UK

Expert witness in a claim for professional negligence against the designer of a major plant rebuild – gave testimony in the Manchester TCC

Mineral processing, UK

Advised in professional negligence claim against a design consultant regarding the suitability and performance of a mechanical handling installation - the case did not proceed.

Pelletized wood dust products, UK

Reported on design and performance failures in a claim against the designer and supplier of pelletization plant.

Photographic film manufacture, UK

Expert witness for the claimant against a supplier of emulsion handling plant – gave testimony in the Birmingham TCC

Food manufacture, UK

Provided a manufacturer with advice in relation to a claim for contamination of product with fragments of machine parts - settled out of court.

Electroplating plant, UK

A fire in an electroplating factory was attributed to defective design or manufacture by an electrical contractor. Careful forensic investigation revealed evidence of incorrect installation and the influence of a corrosive environment, overturning the findings of previous investigations - settled out of court

Printing works, UK

Advised and reported on the causes of fires in two large printing works – settled out of court

Plastics extrusion plant, UK

Expert determination – decided claim for damage to machinery and loss of production due to equipment malfunction

Aircraft manufacture, UK

Advised on mechanical and electrical aspects of automatic production crane performance – settled by mediation

In addition, Dick Ward has advised and provided expert reports in numerous cases of industrial personal injury involving process plant, manufacturing machinery, and mechanical handling/access equipment, giving oral testimony on occasion.

Other Activities

Dick Ward is Principal of the firm of Robert Bruce & Sons which works in close association with Cadogans on selected assignments. He represents the Association of Consultancy and Engineering on the British Standards committee on continuous material handling machinery. He is a Fellow of the RSA, and a Member of the Society for the Preservation of Ancient Buildings.
